1. Scope of Application
1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Ermin Ciric, operating under "Life Coaching & Personal Development - Ermin Ciric" (hereinafter referred to as "Provider"), apply to all contracts for the provision of services that a consumer or entrepreneur (hereinafter referred to as "Customer") concludes with the Provider regarding the services presented by the Provider on his website. The inclusion of the Customer's own terms and conditions is hereby objected to unless otherwise agreed.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. An entrepreneur within the meaning of these GTC is a natural or legal person or a legal partnership that acts in the exercise of its trade, business, or profession when concluding a legal transaction.
2. Conclusion of Contract
The Customer can submit a non-binding request for an offer to the Provider by telephone, fax, email, letter, or via the online contact form provided on the Provider's website. The Provider will send the Customer a binding offer for the selected service by email, fax, or letter. The Customer can accept this offer by submitting a declaration of acceptance to the Provider by fax, email, or letter, or by paying the fee offered by the Provider within 7 (seven) days of receiving the offer, where the day of receiving the offer is not included in the calculation of the period. For acceptance by payment, the day of receipt of payment by the Provider is decisive. If the last day of the acceptance period falls on a Saturday, Sunday, or a public holiday at the Customer's place of residence, the next working day shall take the place of such a day. If the Customer does not accept the Provider's offer within the aforementioned period, the Provider is no longer bound by his offer. The Provider will specifically inform the Customer of this in his offer.
3. Right of Withdrawal
Consumers generally have a right of withdrawal. Further information on the right of withdrawal can be found in the Provider's withdrawal instructions.
4. Cancellation of Appointments
4.1 Independently of any statutory right of withdrawal that may exist, the Provider grants the Customer the right to cancel their appointment for a service provided by the Provider free of charge under the following conditions (contractual right of withdrawal):
4.2 The Customer may cancel their appointment up to 4 days before the start of the booked service without stating reasons by submitting a declaration in text form (e.g., email) to the Provider. The receipt of the declaration by the Provider is decisive for the compliance with the cancellation deadline. If the Customer cancels their appointment in due time, the Provider will refund any payment already made within two weeks from the receipt of the declaration. The Provider may use the same payment method for the refund that the Customer used for payment to the Provider.
4.3 Any statutory right of withdrawal that the Customer may have is not affected by the above-mentioned right of withdrawal.
5. Prices and Payment Terms
Unless otherwise stated in the Provider's service description, the prices quoted are total prices that include statutory VAT.
6. Liability for Defects
The Provider is liable for defects in the provided service in accordance with the statutory provisions on liability for defects.
7. Applicable Law
7.1 All legal relationships between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the laws on the international sale of movable goods. For consumers, this choice of law applies only insofar as the protection provided by mandatory provisions of the law of the country in which the consumer has their habitual residence is not withdrawn.
7.2 Furthermore, this choice of law does not apply with respect to the statutory right of withdrawal for consumers who, at the time of the conclusion of the contract, do not belong to a member state of the European Union and whose sole place of residence and delivery address is outside the European Union at the time of the conclusion of the contract.
8.Alternative Dispute Resolution
8.1 The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr
This platform serves as a point of contact for the out-of-court settlement of disputes arising from online sales or service contracts involving a consumer.
8.2 The Provider is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
